VIRTUS Centre

These Terms & Conditions govern your use of the facilities, services, programs, memberships, coaching services, and website operated by VIRTUS Centre (“VIRTUS”, “we”, “our”, or “us”).
By purchasing a membership, attending a session, participating in a program, signing a membership agreement form, or accessing our facilities, you agree to these Terms & Conditions.
1. Membership Agreement
Memberships are ongoing unless otherwise specified and continue until cancelled in accordance with these Terms & Conditions.
Memberships are non-transferable and may only be used by the registered member. Only the member named in the membership agreement may access VIRTUS Centre using their membership credentials.
Members must maintain accurate and current contact and health information with VIRTUS Centre at all times.
2. Membership Fees & Payments
Membership fees are payable in advance via the nominated payment method. By joining VIRTUS Centre, members authorise recurring payments for membership fees and associated charges.
All membership fees must be paid before services are delivered. It is the member's responsibility to ensure sufficient cleared funds are available on each billing date.
Failed / Dishonoured Payments
If a payment is dishonoured, the following applies:
A failed payment fee of $5.50 will apply to each dishonoured transaction.
Any additional bank charges incurred as a result of a failed payment are the member's responsibility.
VIRTUS Centre will endeavour to contact the member by phone, SMS, or email to notify them of any overdue payment.
VIRTUS Centre reserves the right to retry the payment and suspend facility access until outstanding fees are paid.
Repeated failures to meet payment obligations may result in membership suspension or termination by written notice.
Any outstanding amounts remain immediately due and payable upon termination.
Fee Changes
VIRTUS Centre reserves the right to change membership fees at any time. Members will be provided with a minimum of 30 days written notice before any fee changes take effect.
3. Membership Suspension (Pause)
Members may request to pause their membership under the following conditions:
Pause requests must be submitted in writing via email to VIRTUS Centre.
To be eligible for a pause, the member's account must be in good standing with all fees paid and up to date at the time of the request.
During a membership pause, a reduced holding fee of $19.99 per week will be charged to the nominated billing account in place of the standard weekly fee.
This holding fee retains the member's dedicated session time slot and coach relationship.
The maximum pause period is 3 months.
The standard weekly membership fee will resume automatically at the end of the nominated pause period.
If a member wishes to return before their nominated pause end date, they must notify VIRTUS Centre in writing.
The $19.99/week holding fee applies from day one of any pause period. Failure to pay the holding fee may result in loss of the member's session time slot.
VIRTUS Centre reserves the right to approve or decline pause requests and may require supporting documentation where appropriate.
4. Cooling Off Period
All new VIRTUS Centre memberships are subject to a 48-hour cooling off period beginning from the date the membership agreement is entered into.
A request to cancel within the cooling off period must be submitted in writing to VIRTUS Centre before the 48-hour period expires.
If cancelled within the cooling off period, VIRTUS Centre will refund all membership fees minus an administration fee of $4.99.
Refunds will be processed within 7 days of receiving the written cancellation request.
After the 48-hour cooling off period has expired, the standard cancellation policy applies.
5. Membership Cancellation
Cancellation by Member
To cancel an ongoing membership agreement, a minimum of 14 days written notice is required via email to VIRTUS Centre.
The member's account must be in good standing — all fees paid and up to date — to be eligible for cancellation.
Membership fees remain payable during the notice period. Any payments processed within the 14-day notice period are non-refundable.
VIRTUS Centre does not offer refunds on sessions already delivered.
No refunds are provided for unused memberships, missed sessions, or change of mind, except as set out below.
Termination for medical reasons must be accompanied by a medical certificate. VIRTUS Centre will consider requests on a case-by-case basis.
In the event of a member's death, the member's estate must provide a death certificate. Any unused pre-paid sessions will be refunded to the estate.
Session Cancellation & No-Show Policy
Your coach dedicates a specific time slot exclusively to you each week. The following cancellation fees apply to individual session cancellations:
12 or more hours' notice — Session cancelled at no charge. Rescheduling is at the coach's discretion based on availability.
3 to 12 hours' notice — 30% of the agreed session fee will be charged, unless the member immediately rebooks to another available time slot within the same week.
Less than 3 hours' notice or no-show — 100% of the agreed session fee will be charged. No exceptions. At this point the coach has already prepared and held that time exclusively for the member.
Repeated late cancellations or no-shows may result in termination of the membership agreement at VIRTUS Centre's discretion.
Termination by VIRTUS Centre
VIRTUS Centre reserves the right to terminate a membership agreement at any time if a member:
Fails to make any agreed payment
Breaches any part of this agreement, gym rules, or VIRTUS Centre policies
Engages in conduct that is improper, unsafe, or harmful to others
Is suspected of engaging in illegal activity on the premises
Termination will be effective from the date written notice is issued. The member is liable for all financial obligations up to and including the termination date.
6. Coaching Programs & Services
Coaching programs, personal training sessions, assessments, and specialised services are delivered based on professional judgment and individual requirements. Results vary between individuals and cannot be guaranteed.
Members acknowledge that outcomes depend on factors including participation, effort, consistency, recovery, nutrition, and adherence to coaching recommendations.
7. Health & Medical Responsibility
Members acknowledge they are responsible for ensuring they are physically capable of participating in training activities. Members must:
Disclose any injuries, medical conditions, illnesses, or health concerns that may impact participation, both before joining and as they arise during membership.
Complete the pre-exercise health screening honestly and in full.
Seek medical advice where appropriate before commencing or continuing an exercise program.
Notify VIRTUS Centre staff of any pain, illness, or injury before using the facility.
VIRTUS Centre reserves the right to restrict participation if it believes training may place a member at risk. VIRTUS Centre has not provided and cannot provide any medical advice.
8. Assumption of Risk
Exercise, strength training, athletic development, and physical activity involve inherent risks including injury, illness, property damage, and in rare circumstances, serious injury or death.
Risks include but are not limited to: soft tissue injuries, joint injuries, broken bones, permanent disability, slipping on wet or uneven flooring, being struck by weights or colliding with equipment or other members, engaging in strenuous exercise beyond current capability, and incorrect use of equipment.
By participating in activities at VIRTUS Centre, members voluntarily assume these risks and agree that participation is undertaken at their own risk.
9. Liability
To the maximum extent permitted by law, VIRTUS Centre, its directors, coaches, employees, contractors, and representatives are not liable for any loss, damage, injury, claim, cost, or expense arising from participation in programs, use of facilities, or access to services.
VIRTUS Centre is not responsible for the loss, theft, or damage of personal belongings while on the premises, including vehicles, their contents, or items left within the facility.
If a member causes damage to VIRTUS Centre or any equipment, the member is liable for the cost of repair or replacement.
Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.
10. Facility Access & Member Conduct
Facility Access
Memberships are non-transferable. Only the registered member may access VIRTUS Centre using their membership credentials.
Members must not share access credentials or permit unauthorised individuals to enter the facility. Breach of this clause may result in a fee and/or membership termination.
Outside of staffed hours, members are responsible for securing the facility as instructed during induction. This includes closing and locking all doors and turning off all lights.
VIRTUS Centre reserves the right to restrict a member's access to staffed hours only if there is concern for their health, safety, or conduct.
Safe Training
Use all gym equipment responsibly and within your current physical capability.
Do not use equipment marked as out of order or restricted during unstaffed hours.
Return all equipment to its correct position and wipe down after use.
Misuse of equipment may result in a damage fee or restricted access.
Conduct
VIRTUS Centre is an inclusive community. Members must respect staff, coaches, and fellow members. Discrimination, harassment, bullying, intimidation, offensive behaviour, or any conduct that makes others feel unsafe will not be tolerated and may result in immediate membership termination.
Members must follow all safety signage and instructions from VIRTUS Centre staff at all times.
11. Video Surveillance
For security purposes, VIRTUS Centre uses video surveillance equipment to monitor the facility. By accessing VIRTUS Centre, members acknowledge they will be subject to video surveillance and recording while on the premises. Surveillance is limited to floor areas only and does not extend to bathrooms or private assessment rooms.
12. Photography & Media
VIRTUS Centre may capture photographs or video content within the facility for marketing, educational, or promotional purposes, including on platforms such as Instagram, TikTok, and YouTube. Content may include group settings and will not include a member's name unless agreed separately.
Members who do not wish to be included in media content must notify VIRTUS Centre in writing and notify a coach directly upon joining.
13. Privacy
Personal information collected by VIRTUS Centre is handled in accordance with our Privacy Policy, which forms part of these Terms & Conditions and is available on our website and upon request.
Members acknowledge they have read and understood the Privacy Policy.
14. Changes to These Terms
VIRTUS Centre reserves the right to update these Terms & Conditions at any time. The latest version will be published on our website and will apply from the date of publication. Members will be notified of material changes.
